Welcome to PureBloom. By accessing or using the PureBloom mobile application and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms. Please review these Terms periodically.

2. Description of Service

PureBloom is an AI-powered nutrition analysis tool that provides personalized food scoring (the "Bloom Score") based on user-selected health goals. The Service includes:

• Barcode and photo scanning for food analysis
• Personalized Bloom Scores (0-10) based on your chosen health goal
• AI Nutritionist chat functionality powered by Gemini 3
• Progress tracking and insights

PureBloom is an educational and informational tool only. It is NOT a substitute for professional medical advice, diagnosis, or treatment.

The Bloom Score, AI recommendations, and all content provided through the Service are for informational purposes only and should not be construed as medical or dietary advice. The information provided is not intended to diagnose, treat, cure, or prevent any disease or health condition.

Always consult with a qualified healthcare provider before making any changes to your diet, especially if you have allergies, food intolerances, medical conditions, or are taking medications. Never disregard professional medical advice or delay seeking it because of information obtained through PureBloom.

4. Eligibility

You must be at least 13 years old to use the Service. By using PureBloom, you represent and warrant that you meet this age requirement. If you are under 18, you should review these Terms with a parent or guardian.

5. Account Registration

To access certain features, you may need to create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly update your information if it changes
• Accept responsibility for all activity under your account
• Notify us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these Terms.

6. Subscriptions and Payments

PureBloom may offer subscription plans for premium features. By subscribing, you agree to:

• Automatic renewal at the end of each billing period unless cancelled
• Provide valid payment information

Subscriptions are managed through Apple's App Store. Cancellations, refunds, and billing inquiries are subject to Apple's terms and policies. To cancel, manage your subscription through your Apple ID settings.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse engineer, decompile, or disassemble the app
• Interfere with or disrupt the Service or servers
• Upload malicious code, viruses, or harmful content
• Scrape, harvest, or collect data from the Service without permission
• Impersonate any person or entity
• Use the Service to provide medical advice to others
• Resell or redistribute the Service without authorization

8. Intellectual Property

The Service, including its design, features, content, and underlying technology, is owned by PureBloom and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

You retain ownership of any content you submit (such as food photos), but grant us a license to use this content to provide and improve the Service.

9. Third-Party Services

The Service integrates with third-party services including Google's Gemini 3 API for AI processing. Your use of these integrations is subject to the respective third parties' terms and privacy policies. We are not responsible for third-party services or content.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or completely secure. Nutritional information and Bloom Scores are provided for informational purposes and may not be 100% accurate.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PUREBLOOM AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR HEALTH, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify and hold harmless PureBloom and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall survive.

You may terminate your account at any time by contacting us or through the app settings.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in San Diego County, California.
